The California Courts have a webpage on how to Vacate a Default Judgment in small claims cases, including information on deadlines, forms to use, what to expect if the judge vacates your judgment, and appealing the denial of a motion to vacate. ORCP 69 requires the court or clerk to enter an order of default on a showing by affidavit or declaration that a party against whom a judgment is sought has been served with Summons or is otherwise subject to the jurisdiction of the Court and has failed to plead or otherwise defend within the time set by law. Below are resources and forms for vacating or setting aside default judgments. If a default judgment has been entered against you there may be ways to have it vacated or set aside. Welcome to the Forms Center Please go to the Self-Help Center to learn more about what forms you may need and find other information about the topics below. If you are sued in a lawsuit and do not properly respond, the court may enter a judgment against you in favor of the plaintiff, called a default judgment.
